연안체험활동 신고제도 개선 연구
연안사고예방법은 안전한 연안체험활동 운영을 위하여 운영자에게 인적·물적요건 의 구비 여부를 신고하도록 규정하고 있다. 그러나, 2015년에는 신고제도에 관하여 헌법소원이 제기되었고, 2022년에는 신고접수가 17건에 그치는 등 신고제도에 대한 종합적인 검토가 필요하게 되었다. 지금까지의 선행연구는 연안사고 예방 또는 안전 관리 체계 강화를 위한 구체적인 이행방안을 제시하였다면, 본 연구는 유권해석과 학리해석을 중심으로 검토하여 법률 개정 방안을 제시하였다는데 그 의의가 있다. 현행 연안사고예방법에서는 신고 주체인 연안체험활동 운영자에 대한 정의 규정 이 부재하며, 신고의무가 제외되는 ‘다른 법률에서 지도·감독받는 법인 또는 단체’에 대한 해석상에 다툼이 존재하는 등 법률 명확성 원칙이 결여되 수범자들이 신고의무를 이행하는데 한계로 작용하고 있다. 이에 연안사고예방법을 다음과 같이 개정할 것을 제언하였다. 첫째, 연안사고예방 법의 규정보다 강화되는 기준을 포함하는 경우를 제외하고 연안사고예방법이 우선 적용되어야 한다. 둘째, 신고 예외 조항을 삭제하여 일정 규모 이하의 연안체험활동을 제외한 모든 활동이 신고되어야 한다. 셋째, 연안체험활동 계획서 신고수리전 참 가자 모집 금지규정을 삭제하는 한편, 운영자가 연안체험활동 안전수칙을 준수하지 않을 경우, 해양경찰청장이 연안체험활동의 제한 권한을 행사할 수 있도록 인정되어야 한다.
A Study on the Improvement of Report on Coastal Sea Experience Activities
The Act on Prevention of Accidents at Coastal Sea stipulates that operators must report whether they meet human and material requirements for safe coastal experience activities. However, in 2015, a constitutional complaint was filed regarding the reporting system, and in 2022, only 17 reports were received, requiring a comprehensive review of the reporting system. While previous studies suggested specific implementation measures to prevent accidents at coastal sea experience activities or strengthen the safety management system, this study has its originality by suggesting the amendment of the Act derived from the rule of interpretation. Currently, in this Act, there is no definition for coastal experience activity operators who is the subject of reporting, and there is a dispute in the interpretation of "corporations or organizations guided and supervised by other laws" where reporting obligations are excluded. The lack of the principle of legal clarity is acting as a limitation for the people in fulfilling their reporting obligations. Accordingly, it was proposed to revise the Act on Prevention of Accidents at Coastal Sea as follows. First, the Act on Prevention of Accidents at Coastal Sea should be applied first, except for cases that include stricter standards than the provisions of this Act. Second, by deleting the reporting exception clause, all activities except for coastal experience activities of a certain size or less should be reported. Third, the clause about the ban on recruiting participants before reporting and repairing the coastal experience activity plan should be deleted, and if the operator does not comply with the safety rules of coastal experience activities, the head of the Korea Coast Guard should be allowed to exercise the restriction authority.
