해양경비법상 추적과 나포의 법적 성격에 관한 고찰
『해양경비법』은 해양경찰 경비활동의 중요한 법적 근거로서 해양경찰의 직무수행 에 법적인 자신감을 불어넣으며 제 역할을 담당해왔다. 해양경찰청의 직무수행에서 경비 기능이 차지하는 비중을 고려해 보면 『해양경비법』은 해양경찰의 중추적인 기본 작용법적 역할을 담당하고 있다. 다만 우리나라 해양경찰 조직이 경찰청과 그 뿌리를 같이 하는 관계로 해양경찰 청의 여러 부분에서 경찰법적인 요소를 포함하고 있고, 해양경찰관의 직무수행에 있 어서도 경찰관의 직무수행과 관련된 내용의 법률을 근거로 하고 있어 해양경찰의 직 무수행 작용에 대한 독자적인 법적 정비와 연구는 부족한 감이 있다. 다른 법에서는 그 형태와 근거를 찾아보기 힘든 해양경찰 고유의 작용인 ‘추적과 나포’는 해양경찰의 중요한 직무수행 중에서 하나이고 그 수행과정에서 갈등적 요소 를 일으킬 소지가 매우 크기 때문에 이에 대한 정교한 법적 고찰이 요구되고 충분한 분석이 이루어진 후에 그에 합당한 직무집행이 필요하다. 이 논문에서는 법에 규정되어 있는 추적과 나포의 법적 성격을 검토하여 해양경 찰 작용의 행정법적 이론을 바탕으로 해양경비법상 추적과 나포를 분석하였고, 이를 통해 국민의 인권을 보장하고 해양경찰관의 직무집행의 법적 확실성을 확보할 수 있 도록 해양경찰의 표준조치로서 추적과 나포를 제안하였다.
A Study on the Legal Characteristics of the Hot Pursuit and Arrest in the Maritime Policing Act
The Maritime Policing Act offers an important legal ground of the policing activities of the Korea Coast Guard, and it has served its role of inspiring legal confidence when the Korea Coast Guard performs its duties. If the proportion of policing function in the Korea Coast Guard’s duties is considered, the Maritime Policing Act would be considered a legal ground so important that it would be no exaggeration to say that the act plays a basic and pivotal legal role for the Korea Coast Guard. As the Korea Coast Guard shares its foundation with the Korea National Police Agency, different parts of the Korea Coast Guard include elements of the Police Act and its performance of duties is grounded on the laws regarding police officers’ performance of duties. Consequently, it appears that there is insufficient independent legal adjustment and research on the Korea Coast Guard’s performance of duties. ‘Hot pursuit and arrest’ is one of the most important duties of the Korea Coast Guard and a unique duty whose legal grounds are hardly found in other laws, and factors of conflict are highly likely to occur when hot pursuit and arrest is performed. Therefore, it is necessary to perform an in-depth legal review and a thorough analysis first and then manage the duty of ‘Hot pursuit and arrest’. In this paper, the legal characteristics of ‘Hot pursuit and arrest’ was reviewed to analyze those on the administrative legal theory of Coast Guard action, and proposed ‘Hot pursuit and arrest’ as a standard measure of Coast Guard to guarantee the human rights of the people and ensure the legal certainty of Korea Coast Guard.
