검·경수사권 조정에 따른 해양경찰 수사 지휘체계 개편의 쟁점 검토
2020년 ｢형사소송법｣ 개정에 따라 경찰이 검사의 수사지휘를 받지 않고 독자적인 권한과 책임 아래 수사를 개시·진행·종결하게 되었다. 이에 일반사법경찰기관인 경찰 청과 해양경찰청은 자체적인 수사지휘체계 구축을 위한 조직 개편을 단행하였다. 다 만 양 기관은 형사소송법상 동일한 수사기관임에도 불구하고 수사지휘체계 개편에 있어서는 결과적으로 상이한 형태를 보이는 것이 특징이다. 이 연구는 특히 해양경찰의 수사지휘체계 개편과 관련하여 2020년 국회의 입법과 정에서 쟁점화 되었던 사항들을 다음의 세 가지로 구분하고, 최종입법으로 도출된 해양경찰 수사지휘체계의 타당성을 검토하고자 하였다. ① 해양경찰의 수사지휘체계 가 ｢헌법｣ 상 ‘민주적 정당성과 통제’의 원리에 부합하는가, ② 수사지휘체계가 ‘독립 성과 정치적 중립성’을 갖추었는가, ③ 수사지휘체계가 해양경찰 수사의 ‘특수성과 전문성’을 반영하였는가 등이 주요 검토사항이다. 연구 방법으로는 해양경찰 수사지휘체계의 이론적 타당성을 검토하기 위하여 舊 검사 지휘체계 당시의 모델들을 배경이론으로 삼았다. 또한, 해양경찰청의 수사지휘 체계를 경찰청과 동일선상에 놓고 비교 고찰하는 검증 방식을 사용하였다.
Review of Issues in Reorganization of the Korea Coast Guard’s Investigation Directive System
In accordance with the revision of the “Criminal Procedure Act” in 2020, the police began, proceeded, and concluded investigations under their own authority and responsibility without receiving the investigation guidance of the prosecutor. Accordingly, the National Police Agency and the Korea Coast Guard, which are general judicial police agencies, carried out organizational reorganization to establish their own investigation directive system. However, despite the fact that the two agencies are the same investigative agencies under the Criminal Procedure Act, they are characterized by different results in reorganizing the investigation directive system. In particular, in relation to the reorganization of the Korea Coast Guard investigation directive system, this study divided the issues that were raised in the legislative process of the National Assembly in 2020 into the following three categories, and tried to review the validity of the Korea Coast Guard investigation command system derived from the final legislation. ① Does the investigation directive system of the Korea Coast Guard conform to the principle of democratic legitimacy and control under the Constitution? ② Does the investigation directive system have independence and political neutrality? and professionalism are the main considerations. As a research method, in order to examine the theoretical feasibility of the Korea Coast Guard investigation directive system, the models at the time of the previous prosecutor's directive system were used as a background theory. In addition, a verification method was used in which the investigation directive system of the Korea Coast Guard was placed on the same line as the National Police Agency and compared.
