해양레저 활동자 관점에서 해양안전정책의 순기능과 역기능 분석 : 해양경찰 소관의 해양안전법률을 중심으로
본 연구는 해양레저활동자 관점에서 해양경찰이 소관하고 있는 해양안전정책(수 상레저안전법, 수상구조법, 연안사고예방법) 제도의 순기능과 역기능을 고찰하고, 이 를 바탕으로 해양안전정책의 효율성을 극대화 할 수 있는 세부 방안을 제공하는 데 목적이 있다. 이를 위해 내러티브 연구 방법(Narrative Research)을 활용하여 법 률의 이해당사자 6인을 연구참여자로 선정하고, 그들의 이야기(Story)를 분석함과 동 시에 객관적 문헌(정부보고서, 각종 문헌 자료)과 교차하여 확인한 다음 검증된 진실만을 담아 연구목적에 부합하는 결과를 도출하였다. 연구결과 해양안전 정책의 순기능으로 첫째, 안전법률은 현장 안전관리가 부재했던 공간에 용어의 개념적 준거 와 안전수칙의 기준점을 정립하여 안전관리체계를 마련하였다. 둘째, 해당 법률에 근 거해 해양경찰은 컨트롤 타워역할을 수행하며 타 부처와 지자체로 하여금 해양안전 문화를 형성토록 하는 계기를 마련하였다. 셋째, 장기적인 관점에서 해양안전에 관한 법률적 기반마련은 안전사각지대로 놓여 있던 영역을 국민적 관심의 대상으로 이끌 게 하는 순기능으로 작용 되었다. 다만, 행정적으로 안전관리 전략이 부족하여 1) 민 간협력 단절, 2) 수상인명구조원의 역량 감소, 3) 사업자의 경제적 손실 등의 역기능 의 문제점이 발생한 것으로 분석되었다. 따라서 해양레저활동자의 눈높이에서 현장 관리가 이루어져야 할 것이라 판단된다.
Analysis of the Proper and Adverse Functions of the Marine Safety Policy from the Perspective of Marine Leisure Activists
The purpose of this study is to examine the proper and adverse functions of the marine safety policy(Water-Related Leisure Activities Safety Act, Water-Related Leisure Rescue Law, Coastal Accident Prevention Law) under the jurisdiction of the maritime police from the perspective of marine leisure activists, and to provide methods to maximize the efficiency of marine safety policy. To this end, six stakeholders of each law were selected as participants in this research, and the study analyzed their stories and collected government reports and various literature materials. First of all, according to the research results, the safety law provided a safety management system in the space where there was no on-site saftey management. Second, based on the relevant laws, the maritime police acted as a control tower and provided an opportunity for other ministries and local governments to form a marine safety culture. Thirdly, from a long-term perspective, the legal basis for marine safety has formed a proper function that leads the area that had been placed as a safety blind spot to the object of interest. However, it was analyzed that the lack of administrative safety management strategies resulted in adverse effects such as discontinuation of cooperation among some private organizations, reduction of capacity of water-related lifeguards, and economic loss of business operators.
