수산자원 보호를 위한 바다낚시 규제의 필요성과 해양경찰의 역할 모색
장기간 지속적으로 해양환경이 오염되고, 수산자원도 감소해 심각한 상황에 이르 렀다. 이러한 상황에서 바다낚시 인구의 급증은 낚시관련 산업에는 호재일 수 있지 만 쓰레기 투기나 채비유실로 인한 환경오염의 악화, 물고기 등 남획으로 인한 수산 자원의 감소라는 폐해를 가중시키고 있다. 그리고 이러한 상황은 바다낚시를 더 이 상 규제의 사각지대로 남겨둘 수 없는 실정에 이르렀다. 이 논문에서는 바다낚시가 갖는 환경오염과 남획의 실태를 파악하고, 현행 법규의 낚시제한기준, 금지행위 등을 확인하였다. 이미 수산자원을 보호하기 위한 법규가 마 련되어 있음에도 계도나 단속 등의 법집행 활동이 거의 이루어지지 않는 현실의 문 제점을 지적하고 그 대안을 모색하고자 하였다. 미국과 캐나다 등 해양 선진국의 낚시규제 특징을 살펴보고, 이를 교훈삼아 우리 나라에도 강력한 권한과 전국적 규모의 법집행 조직에 의해 낚시가 엄격히 관리될 필요가 있다는 결론에 다다랐다. 국내의 현 실정에서 해경은 그 역할을 수행하기에 가장 적합한 조직으로서 수산자원의 위기와 낚시규제의 필요성에 대한 인식을 정착 시키고, 바다낚시가 건강한 레저활동으로 자리 잡도록 하는데 적극 참여하여 중추적 인 역할을 할 것을 주요 대책으로 주장하였다. 그 외 자율적인 법규준수를 위한 민 간협력과 입법사항 등도 함께 대안으로 제시하였다.
The Need for Sea Fishing Regulations to Protect Fishery Resources and Searching for the Role of Korea Coast Guard
The marine environment has been continuously polluted for a long time, and fisheries resources have decreased, leading to a serious situation. Under these circumstances, a surge in the population of sea fishing may be a boon to fishing-related industries, but it adds to the harmful effects of worsening environmental pollution and a decrease in fishery resources caused by overfishing. And this situation has led to the fact that sea fishing can no longer be left as a blind spot for regulation. In this paper, the actual conditions of the environmental pollution and overfishing of sea fishing were identified, and the fishing restriction standards and prohibited acts of the current law were confirmed. Although laws were already in place to protect fisheries resources, we pointed out the problems of the reality where there were few law enforcement activities such as guidance and crackdowns, and tried to seek alternatives. Taking a look at the characteristics of fishing regulations in advanced maritime countries such as the U.S. and Canada, we came to the conclusion that fishing needs to be strictly managed by strong authority and law enforcement organizations on a nationwide scale. In the real world situation in Korea, the Coast Guard suggested a pivotal role in establishing awareness of the crisis of fisheries resources and the need for fishing regulations, and actively participating in the establishment of a healthy leisure activity. Other matters concerning private sector cooperation and revision of the law were also proposed as alternatives.
