연안사고 감소를 위한 해상집행기관의 법제적 안전관리방안 고찰
사회적 환경 변화에 따라 경제적, 시간적으로 개인생활의 여유가 생기고, 해양스포츠 및 해양레저 활동에 대한 국민들의 긍정적인 의식변화와 함께 연안을 중심으로 개인 또는 단체로 참여하는 연안체험 및 캠프활동, 해양관광 등에 대한 관심이 높아 지면서 여가생활을 즐기고자 하는 레저인구가 자연스럽게 증가하고 있는 게 현실이다. 이처럼 연안에서의 레저 활동이 증가함에 따라 연안사고는 이와 비례하여 발생하 고 있고, 해마다 비슷하게 발생하고 있는 연안사고의 원인은 안전의식 불감증인 인 적요인, 수익성 위주의 운영 및 잠재적 위험이 많은 장소 등의 사회·환경적 요인, 안 전관리에 대한 미비한 관련 법령 등의 법적·제도적 요인들을 들 수 있으며, 해양사고 의 약 90% 이상을 차지하고 있어 이를 예방하여 국민의 소중한 생명과 재산을 보호 하고 공공의 안전을 확보할 수 있는 현실적인 정책 마련이 필요하다고 할 것이다. 그러므로 본 연구에서는 통영의 해양경찰서, 경찰서, 소방서 및 시청 등 각 기관 의 연안안전전문가를 대상으로 설문조사를 하여 내용별로 검토하고 분석하였으며, 또한 최근 5년간의 연안사고에 대한 연안안전 및 사회적·제도적 현황을 분석하고 고 찰하여 연안안전사고를 감소할 수 있는 해상집행기관인 해양경찰의 연안안전관리 활 동 및 법적·제도적 개선방안을 제안하고자 한다.
A Study on the Legislation’s Safety Management Plan of Maritime Enforcement Organization for the Reduction of Coastal Accidents
With the increase of national income and the settlement of the five-day workweek and social conditions, economic and time leeway increased, such as beachfront and coastal camp activities, tourism and maritime sports were increasing, coastal accidents accounted for more than about 90 percent of marine accidents. Therefore, for safety management of coastal accidents, the concept of coastal accidents and the safety management system were explored, including domestic coastal safety management activities and legal grounds and foreign coastal safety management administrative agencies. In addition, the accident status was analyzed for the recent five years, and the survey on safety management measures to reduce coastal accidents was conducted by 300 experts, including maritime police, to visit the police station in cooperation with the education and training support team of Tong-yeong Coast Guard Station. Through this process, it is deemed necessary to improve laws, systems, society and practice to reduce coastal accidents. The new suggestion includes the need to reorganize and activate the operation of the 122 Coastal Guard, the need to integrate into the Coastal Safety Management Act, the need to re-establish the concept of legal maritime accidents, the need to spread the safety culture along with the people, the need to establish a site-based safety management system. Especially in the coastal areas to secured so that people can enjoy leisure activities such as marine leisure sports, the safety management system should be brought up to a certain level in order to reduce coastal accidents.
