해상보안 법체계의 개선방안에 관한 연구
오늘날 세계는 테러로부터 안전한 국가는 없다고 한다. 더욱이 해상 및 항만이 국가위협의 테러수단으로 이용되어, 그 양태가 시시각각 변화하고 다양하게 발생한다. 해상보안에 관한 SUA협약 및 ISPS Code를 수용하여 국내법도 마련되어 있다. 그러나, SUA 협약상의 기준과 국내기준이 불일치하거나, 항만보안에서 제외된 대상에 대한 해상테러발생의 가능성 등 여러 문제점이 거론되고 있다. 이에 해상안전을 위한보다 강화된 보안체계의 구축을 위해 법제도적 개선방안과 법시행 측면의 개선방안을 제안하고자 한다. 첫 번째로 법제도적 개선방안으로, 2005년 SUA협정체제의 비준및 국내법 개정을 들 수 있다. 이를 통해 해상 및 항만테러에 대비한 국제협력과 그이행을 충실히 해야 할 것이다. 두 번째로 법시행 측면의 개선방안으로, 보안주체의단일화가 추진되어야 할 것이다. 해상 및 항만에 대한 보안이 해양수산부와 해양경찰청 두 기관에서 이루어지는 바, 보다 전문적인 항만통제를 위해 단일기관으로 권한을 이전하고 시행하는 것이 합리적이라 생각한다. 사법권이 부여된 해양경찰청을주축으로 항만 및 선박의 테러, 해상사이버테러 등에 대한 대비와 대응이 이뤄지고각 관계기관과 협조함으로써 더욱 강화된 해상보안체제를 구축할 것으로 기대한다. 해상, 항만, 선박 등에 대한 테러, 강도등의 위협으로 인한 인명손상 및 경제적 손상, 더욱 나아가 국가적 손실을 방지하고, 해상보안을 강화할 수 있는 방안을 실행함으로써 안전한 무역국으로서의 항만활성화를 꾀할 수 있을 것이다.
A Study on the Improvement of the Marine Security Law System
Today the world is exposed to th danger of terrorism. Especially maritime and ports are used as a means of national threat. The kind of terror has changed and diversified. A stronger security system for maritime safety is required. For a strong security system, two aspects of improvement should be realized first. First, the 'Act on Punishment for Damaging ships and sea structures' should be ratified and amended by the SUA Agreement of 2005. Though this process, international cooperation and implementation in preparation for maritime and port terrorism should be faithfully carried out. Second, the unification of security agencies should be promoted. Security for maritime and ports is provided by Ministry of Oceans and Fisheries and Korea Coast Guard. It is reasonable to transfer and enforce authority to a single institution for more professional port state control. In order to establish an enhanced maritime security system, Korea Cost Guard should focus on preparing and responding to terrorism on ports and ships and must cooperate with the relevant authorities. By strengthening the maritime security system, we will be able to prevent losses due to maritime terrorism. And The port could be activated by a safe harbor.
