After the end of Korean War, Korea Coast Guard(KCG) had done limited tasks such as being supportive to the naval forces. However in 1953 when the Maritime Police Department was established, they has been also able to do wider judicial police authority like crackdown foreign fishing vessels, conservation of fishery resources prevent spy infiltrating, stowaways and smuggling. Since then, the Korea Coast Guard has improved its function as a powerful police enforcement which was concentrated only on some police activities area. And some of their duties became wider range of working as safety management area like salvage, search and rescue, the marine traffic safety management, marine environment conservation and marine pollution control etc. As such, the Korea Coast Guard carries out various legal duties in the marine environment, but in reality, the jurisdiction laws in charge of the Korea Coast Guard are only a small part of what is being done. In the 21st century maritime age, the readjustment of the jurisdictional legal system, which can be a means to effectively performing the roles and functions of the maritime police, would be an important task at the national level. Therefore, this article would like to discuss about appropriate management of the maritime law requiring transfer and operate to the KCG for the purpose of responding more effectively to the marine safety policy promoted government.
