해양안전을 위한 해양경찰의 직무역량강화에 관한 소고
우리의 안전을 위협하는 범죄는 육지는 물론 해양에서도 끊임없이 발생하고 있다. 해양에서 발생하는 범죄에 대한 예방과 진압도 육지에 못지않게 중요시 되고 있으며, 이러한 범죄의 예방 및 진압은 해양경찰이 그 한 몫을 담당하여 왔다. 그러나 2014년 세월호 침몰사고를 계기로 해양경찰청이 국민안전처 소속의 해양경비안전본부로 조직이 개편되면서 사실상 그 기능이 축소되었다. 즉, 정보·수사기능은 경찰청으로 이관되었고, 해양에서의 경비·안전·오염방제 및 해상에서 발생한 사건의 수사 기능만을 국민안전처로 이관하였다. 해양에서 범죄의 예방 및 진압의 중추적인 역할은 아직도 해양경찰이 하고 있다. 그러나 해양경찰청의 해체로 인하여 활동범위가 축소되어 불안한 상태에서 해양을 담당하기에는 역부족이라 할 수 있다. 최근 여러 나라가 해양세력을 강화하고 있는 현실을 감안할 때 우리나라도 해양의 중요성을 인식하고 약화된 해양경찰의 기능을 더욱더 강화하여 해상치안을 효율적으로 대응하여야 할 것이다. 그러나 해양경찰청이 해체되고 그 소속도 국민안전처 소속으로 변경됨으로 인하여 국민안전처가 해양의 안전을 위하여 신속하고 일사분란하게 할 수 있게 된 반면에 해양에서의 특수사항을 고려하여 해양경찰이 독자적으로 담당하여 왔던 전문적인 업무와 지역의 특성에 맞는 범죄의 단속을 효율적으로 수행하기에는 한계가 있다고 본다. 따라서 본고에서는 현행 우리나라의 해양경찰의 업무와 기능 및 주요 외국의 해양경찰제도를 비교하여 살펴봄과 동시에 현행 해양경찰의 문제점을 개선하여 해양경찰의 역량강화를 위한 방안을 제시하였다.
A Study on the Empowerment of the Coast Guard Duties for Maritime Safety
Crime are constantly occurring on land as well as marine, and they are threaten our safety. Prevention and suppression of crimes that occur on land are important. However, crime in the ocean is important such as land. Meanwhile, the Korea Coast Guard has been to charge the crime prevention and suppression of Marine. But, in 2014 the marine police as the cause of the sinking of the Sewol ferry, this organization was reorganized as the National Security destination and its function was reduced. In short, information and investigation functions were transferred to the National Police Agency, and guard safety. Pollution prevention and investigation functions of incident at sea in maritime safety was relegated as National Security destination The main role of the prevention and suppression of crimes at sea are still the marine police. However, the marine police was disbanded due to the reduced scope of activities. Therefore, this point is difficult marine police in charge of that role. Thus to ensure the power of the ocean can be also enhanced functions of the authority of the Coast Guard. In this paper, I examined the work and functions of the Coast Guard, and I looked at the marine police institutions in foreign countries, and I presented the problems and improvement of existing marine police.
