경찰청 해양범죄 수사조직의 역할 고찰 : 해양범죄수사대 수사내용을 중심으로

세월호사건 이후, 2014년 11월 해양경찰청은 국민안전처 산하의 해양경비안전본부로 재편되면서 수사와 정보인력 상당수를 경찰청에 이관하였다가, 2017년 7월 다시해양수산부 산하의 해양경찰청으로 환원되면서 수사기능을 회복하였다. 해양범죄를 수사하는 기관이 원래의 해양경찰청으로 통합되어 지정된 것은 해양범죄수사를 전체적이면서 거시적인 관점에서 수행할 수 있다는 측면에서 생각해볼때 뒤늦게나마 매우 잘된 일이다. 하지만, 그동안 경찰청이 해양범죄 수사전문조직을마련하고 그에 따른 인력을 확충하며 관련된 전문교육을 해왔던 노력에 대한 평가가전혀 이루어지지 않았다는 점과 그동안 이루어놓았던 해양범죄수사와 관련된 모든성과가 수포로 돌아간다는 점은 매우 안타까운 일이다. 경찰청이 지난 2년 8개월 동안 해양범죄 수사를 위해 준비했던 과정과 쏟아 부은수고에도 충분한 의미를 부여할 수 있을 것이고, 그 동안에 실시한 해양범죄 수사의내용을 분석하면 앞으로의 해양범죄 수사에 대한 충분한 시사점을 찾을 수 있을 것으로 판단된다. 또한 이러한 고찰을 통해 해양범죄에 대한 경찰청과 해양경찰청 수사의 방향성을 검토해볼 수 있을 것이다. 경찰청과 해양경찰청 간 수사기능의 협력과 소통은 지속적으로 필요하다. 두 기관의 조화로운 협력을 통해서만 각 기관 간 관할의 구분으로 경시될 수 있는 사각지대에서 발생하는 범죄의 소탕 가능성이 더 높아질 수 있다. 이 논문에서는 해양경찰청의 수사기능 일부가 경찰청에 이관되었다가 다시 복귀될 때까지 경찰청의 수사2과, 해양범죄수사대 등 해양범죄 수사조직과 그들이 담당했던 해양범죄 수사에 대한 내용을 검토하였고, 이를 통해 장차 해양경찰청에서 해양범죄를 수사함에 있어 다각적인 시각을 가지고 한층 더 전문적인 수사영역의 확대와 분야별 집중화를 이룰 수 있을 것이다.

A Study on the Role of Maritime Criminal Investigation Organizations under the National Police Agency : Focusing on the Contents of Investigation by Maritime Criminal Investigation Team

As reorganized into the Maritime Security and Safety Headquarters under the Ministry of the Interior and Safety in November 2014 after the Sewol ferry disaster occurred, Korea Coast Guard transferred a considerable number of investigation and information workers to the National Police Agency. The Maritime Security and Safety Headquarters was, however, restored to the Korea Coast Guard under the Ministry of Oceans and Fisheries in July 2017; it regained the investigation function. That the maritime criminal investigation organizations have been incorporated into the original Korea Coast Guard is belated but good, given that the maritime criminal investigations can be carried out from a holistic and macro perspective. However, it is to be regretted that there has been no evaluation of the efforts that National Police Agency made to establish the investigation specialist organization, expand the manpower accordingly and carry out the related professional education, and that all the accomplishments related to the maritime criminal investigation that National Police Agency has made will come to naught. A high value would be placed on the process and efforts that the National Police Agency has prepared and made for maritime criminal investigation over the past 2 years and 8 months. An analysis of the contents of the maritime criminal investigation that has been undertaken will provide sufficient implications for future maritime criminal investigation. In addition, this analysis can contribute to examining the directions of the maritime crime investigation by the National Police Agency and the Korea Coast Guard. There is a need for continuous cooperation and communication for the investigation function between the National Police Agency and the Korea Coast Guard. Only harmonious co-operation between the two institutions can raise the possibility to eliminate crimes occurring in blind spots, which can be neglected due to the division of jurisdiction between institutions. This study examined maritime criminal investigation organizations, such as the 2nd Investigation Division and Maritime Criminal Investigation Teams of the National Police Agency, and the contents of the maritime criminal investigation they have performed until some of the investigation functions of the Korea Coast Guard were transferred to the National Police Agency and then returned to the Korea Coast Guard. This examination may help the Korea Coast Guard to expand the scope of more specialized investigation and achieve sectoral centralization with a multifaceted perspective in investigating maritime crimes in the future.
