｢해사안전법｣ 상 항로지정방식의 문제점과 개선방안에 관한 연구
우리나라 ｢해사안전법｣은 선박이 통항하는 항로, 속력 및 그 밖에 선박 운항에 관한 사항을 지정하는 항로지정방식을 제정․운용하고 있는데, 국제해상충돌방지규칙의 통항분리방식을 거의 그대로 수용한 통항분리제도(제68조)와 우리나라 연안해역의 특수한 지리적 조건과 항로 및 수역의 특성과 교통환경을 고려한 독자적인 항로지정방식인 교통안전특정해역의 설정(제10조) 및 항로의 지정(제31조)이 바로 그것이다. 그러나 선박간의 충돌 위험성을 인위적으로 제거하여 충돌을 예방하고자 하는 항로지정의 목적과는 달리, 국제해상충돌방지규칙과 ｢해사안전법｣ 상의 통항분리방식의 적용범위의 차이, 항로지정에 관한 불명확한 법조문, 다양한 존재형식의 항법규정과 각 규정간의 중첩 적용 등의 문제점이 내포되어 있다. 이로 인해 항로지정방식이적용되는 수역을 항행하는 항해사, 해양경찰은 물론 해상교통의 관제를 담당하는VTS 관제사에게 당시 상황에 적합한 항법의 적용과 상대선박과의 진로우선권 파악등에 혼란을 주고 있다. 이 논문에서는 이러한 문제 해결을 위해 통항분리제도의 적용범위와 조문을 개정하고 항로안전법(가칭) 신설과 해사안전법 통항분리제도로의 통합 운영 등의 개선방안을 제안하고자 한다.
A Study on Issues and Reform Measures of Ship's Routeing in the Maritime Safety Law
The Maritime Safety Law establishes and operates a Ship's Routeing system that specifies the routes, speeds, and other matters related to the operation of ships. There are Traffic separation schemes(Article 68) that accepts the International Regulations for Preventing Collisions at Sea(COLREGS), Setting of Traffic safety specific sea area(Article 10) and Ship's Routeing(Article 31) which considers special geographical conditions of the coastal waters, as well as the characteristics of the route and water area and the traffic environment. The purpose of Ship's Routeing is to prevent ship's collision by artificially eliminating the risk of collision. but there are various problems such as differences in the scope of application between COLREGS and maritime safety law, unspecified contents for Ship's Routeing, navigation rules of various existence forms and superposition between regulations. As a result, navigators, Korea Coast Guard, and controllers responsible for vessel traffic service have been confused by the application of navigation rules suitable for the situation and by understanding the priority with the other side of the vessel In this study, in order to solve these problems, I would like to suggest ways to modify the application scope of the traffic separation scheme, revise the articles related to the crossing prohibition on the Maritime Safety Law, establish The Routeing safety law(tentative name), integration with the traffic separation scheme.
