EEZ에서의 해양경찰의 공용화기 사용에 대해 : 해양경찰의 무기사용의 근거와 한계를 중심으로

이 글에서 필자는 배타적 경제수역(EEZ)에서 해양경찰이 공용화기를 사용하여 중국어선을 단속할 수 있는가라고 하는 문제를 다루고 있다. 이 문제는 배타적 경제 수역(EEZ)이 공해도 아니고, 영해도 아닌 특수한 영역으로서의 성격을 가진, 즉 독 특한 (sui generis)해역이기 때문에 발생하는 것이다. 즉 영토(Territory)라면 법집행 권의 행사로서 무력행사가 얼마든지 가능하고, 그렇기 때문에 공용화기를 사용하는 것도 허용되지만, 공해라면 자유항행의 권리를 누리기 때문에, 불법행위를 하지 않는 한 무력행사를 하여 단속할 수는 없기 때문이다. 이를 검토해 본 결과를 요약하면 다음과 같다. 일정한 조건이 충족된다면 외국선박에 대한 법집행활동 시 무력사용이 수반되는 것은 국제법상 일반적으로 인정되고 있다. 그리고 법집행활동의 일환으로서의 무력 사용과 국제관계에서의 무력행사를 구별하는 데 있어서는 특히 취해진 조치의 목적 과 적용되는 법적근거가 중요한 기준이 된다. 또한 국제법상 허용되지 않는 외국선 박 차단의 국제법상 허용여부는 기본적으로 차단의 적법성 여부와 관련된 것이며 그 것이 차단과 이에 수반된 무력사용의 성격을 결정하는 것은 아니다. 따라서 외국선 박을 차단할 국제법적 권한이 존재하지 않거나 불분명한 상황에서 차단에 나아간 경 우에도, 그 차단은 법집행적 성격을 지닐 수 있다. 그리고 이러한 성격의 차단에 수반된 무력사용 부분에 있어서는 이를 규율하 는 국제법상의 기준에 따라 그 적법성 여부에 대한 별도의 판단이 필요하다. 이와 관련하여 관련 판례와 관련 조약 규정에 따르면, 무력사용의 최후수단성과 무력사용의 필요성 및 합리성, 무력사용 전 경고, 법집행 또는 기타 공무원들의 자위 권은 이미 국제관습법의 지위를 획득하였다고 생각한다. 이 중에서도 가장 핵심적인 원칙인 동시에 가장 추상적인 원칙이라고도 할 수 있는 것은 무력사용의 필요성 및 합리성 원칙이다. 다만 그 판단에 있어서 쉽지 않은 문제를 제기한다. 기본적으로 대 상 선박의 범죄혐의의 성격이 중요한 변수로 작용한다. 그러므로 외국선박에 대한 차단 과정에서 수반된 무력사용이 국제법상 무력행사 금지원칙에 위배되지 않도록 주의하는 한편, 국제법상 확립된 외국선박에 대한 법집 행활동 시의 무력사용 원칙을 준수함으로써 국제법 위반에 따른 국가책임을 부담하 게 되는 일이 없도록 해야 할 것이다. 또한 국내법적으로도 많은 문제가 제기된다. 이 모든 것은 공용화기의 사용을 위한 매뉴얼이 내부결재용으로 되어있다는 점에 기 인한다. 이 모든 문제를 해결하기 위한 방법은 적어도 법규명령의 성격을 가지도록 하고, 그 내용도 지금보다 구체적으로 규정하여야만 한다.

The use of crew served weapon against illegal fishing foreign vessels by KCG in the EEZ : Focusing on the Ground and the Limit of the Use of Force

In this article, I am dealing with the question of whether the maritime police can interdict the Chinese fishing vessels by using crew served weapon in the Exclusive Economic Zone(EEZ). The problem is that the exclusive economic zone(EEZ) is not the territorial property of the territorial waters, but also the unique territorial waters that hold the characteristics of high seas. It is well established that in international law force may be used during maritime law enforcement against foreign vessels under certain conditions. The purpose of the measures and the legal basis that apply are suggested as important criteria to distinguish categories. On the other hand, some argue that if there is not flag-state consent given in advance to interdicting a flag vessel in international waters, or a specific exception allowing the interdiction, it will be prohibited as a use of force. However, it seems that unlawful interdiction will not necessarily constitute the use of force in the sense of UN Charter Article 2(4). The lawfulness of the jurisdictional basis does not as such determine the nature of the action. The measures which are not characterized as the use of force in international relations are considered from the point of view of the basic principles that govern the use of force as law enforcement action. Although the international legal limits on the use of force in maritime law enforcement context were examined in three leading cases, the recent consensual interdiction arrangements have included provisions related to the use of force, which have become more detailed. Considering such cases and arrangements, the following principles may be regarded as customary international law: the use of force must be avoided as far as possible and where force is unavoidable it must not go beyond what is reasonable and necessary in the circumstances; a warning shall be given prior to any use of force; law enforcement or other officials are entitled to exercise inherent right of self-defence. In particular, the principle of necessity and reasonability requires the interdicting State to weigh the nature of violation by a suspected vessel.
