국가비상사태 발생 시 선박 동원과 해기사 소요 인력에 관한 연구 : 상선해기사를 중십으로

우리나라는 유사시 국가가 민간선박과 해기인력을 동원할 수 있는 체제를 운영하 고 있으며, 이는 헌법, 징발법, 비상대비자원법, 국제선박등록법, 병역법, 예비군법 등 을 근거로 하고 있다. 우리나라 뿐 아니라 해외에서도 이러한 체제를 운영하고 있으 며 미국은 해상보안법, 일본과 중국은 국가동원령, 예비자위관보제도, 국방교통법 등 을 통해 민간선박을 동원할 수 있도록 하고 있다. 본 논문에서는 우리나라와 해외의 민간선박 및 해기인력 동원 체제에 대해 조사 하고, 국내 선원선박통계를 이용하여 동원 가능 선박 척수와 전체 해기인력을 산출 하였으며, 산출된 결과와 선박동원체제 관련 법령을 근거로 실제 선박 동원 시 필요 한 해기사 소요 인력을 도출하였다. 또한 최근 국방부에서 추진하고 있는 승선근무 예비역제도의 폐지나 규모 축소가 동원선박 및 국가필수선대 운용에 미치는 영향에 대해 연구하였다.

Study on the Required Manpower for Ship Officer and Ship Mobilization in Case of National Emergency

In Korea, the government operates a system to mobilize civilian vessels and seafarers in case of emergency, based on constitution, requisition law, emergency preparedness resource law, international ship registration law, military service law, reserve army law. The system is operated not only in Korea but also overseas. United States is allowing maritime security law, and Japan and China can mobilize civilian vessels through national mobilization, preliminary self-defense system and defense transportation law. In this paper, we investigate the system of mobilization of civilian vessels and seafarers in Korea and overseas, and calculate the number of vessels capable of mobilization and the total number of manpower using domestic vessel source statistics. Based on the calculated results and the laws related to vessel mobilization system, the number of seafarers needed for actual ship mobilization was derived. In addition, it is studied that how influence to mobilized vessels and national essential fleet operation by abolition or reduction of the size of the reserve forces for embarkation duty system conducted by Ministry of National Defense recently.
